President of Kazakhstan attends judges’ congress

Astana, November 19, 2009 (Khabar) - The head of state has set a number of priority tasks for the national system of public justice. Nursultan Nazarbayev addressed a congress of judges of Kazakhstan and noted that the state has done a lot to supply the judiciary with independence and a decent life. People have a right to demand from judicial power protection of the law and justice.

Nursultan Nazarbayev, President of Kazakhstan:
- Fair and incorruptible trials are the core basis for a democratic and law-abiding state. One of the main accomplishments of Kazakhstan is said to be the acquisition of not only technical but also factual independence for courts and judges. Judges are appointed on a permanent basis by the head of state in Kazakhstan. This enables them to work without watching the reaction of ministers, mayors and governors, deputies and their own court authorities.

Kurbangali Kamalov, judge of the Almaty city court:
- President of the republic, appointing judges of the gives us more rights and opportunities to consider any criminal and civil cases without regard in the legal basis and always solve the problems faced by the court with dignity, and to avoid any legal wrangling on the part of our citizens.

The state has secured not only independence, but also a decent life for judges. The representatives of justice are one of the highest-paid among other government employees. Their wage has risen by 60% this year alone.

Kairat Mami, the General Prosecutor of Kazakhstan:
- I think Kazakhstan established the judicial system during the years of independence as well as the judiciary and the judicial system of Kazakhstan meets all international standards. The judicial system of Kazakhstan is in a position to do justice to all canons of international standard.

- Reform of the judicial system goes to a new stage, stage of judicial review and convergence time making decisions are reduced

There are 2433 judges in Kazakhstan today. According to statistics, the quality of their work is improving from year to year. In particular, the number of complaints is reducing.

Musabek Alimbekov, chairman of Supreme Court of RK:
- According to the results of nine months 95% of decisions on civil cases, 80% on criminal cases and 97% on administrative violations were not appealed against by non side and protested by the prosecutor.

However, it is too early to speak about perfect justice. Nursultan Nazarbayev defined a circle of central problems of national judges.

- The first problem is the cases of dishonest people getting employed in the judicial system. The second is the inadequate professional level and moral portrait of certain judges. The third problem is represented by complaints about the quality of the administration of justice. The fourth problem is related to the imperfection of legal procedures. The fifth issue lies in the degree and quality of execution of judgment. The sixth one lies in the issues of the legislation’s state.

Nursultan Nazarbayev has already approved the concept of the legal policy of Kazakhstan designed for the next 10 years where special attention is focused on the modernization of the public justice system. At the congress, the president explained which tasks were to be fulfilled by the judicial power. The head of state announced that it is necessary to raise the insistence of high standards for judges, such as the skill level as well as their moral character.

Onalsyn Zhumabekov, chairman of the Supreme Judicial Council of RK:
- I have been impressed by the speech of the President. In particular, I draw attention to the need to increase the requirements for judges, increasing the requirements for the selection of candidates, judges among candidates. It is necessary to further improve transparency, and thus do everything that the judges do not infiltrate the ranks of people who do not meet this high calling.

Nursultan Nazarbayev, President of RK:
- Work should be continued to improve and simplify the proceedings, the creation of conditions, to eliminate red tape, judicial errors and violations of law by judges themselves.

Nursultan Nazarbayev suggested introducing a principle of voting by secret ballot when selecting aspirants for the judicial office in order to improve the staff. He also suggested renouncing the paper circulation of documents and introducing “electronic governance” technology so as to speed up legal proceedings. Also, the head of state paid attention to the implementation of court decisions. The president noted that the institution of private officers of the law must help resolve this issue. A great number of foreign guests have assembled for the 5th congress of judges of Kazakhstan. Foreign specialists had a high opinion of the transformations that have been ushered into the Kazakh system of justice.

- I think participation of the President into congress of judges is very symbolic and a good sign, it indicates that the President pays great importance to the development of the judicial system in Kazakhstan. By the way, modern judicial system is very important factor for investors. They first choose such a country to realize their projects.

- I think Kazakhstani President Nursultan Abishevich Nazarbayev has a high reputation not only in CIS countries and abroad. I think he makes a great deal for the development of both Kazakhstan and other former Soviet states.

- Kazakh judicial system is developed and it is gratifying that today President Nursultan Nazarbaye attends the fifth congress. Sure, this attaches great importance to the congress.

He is well-known person around the world, eminent statesman, and he does a lot not only to strengthen the statehood in Kazakhstan, but also for the development of judicial power.

Experts came to the verdict that the country has advanced concerning the state of matters in the justice system of Kazakhstan in comparison with the situation which can be witnessed in other countries of the region. The constant growth of people resorting to the Justice system bears testimony to this.
