HC upholds August 15 as National Mourning Day

DHAKA, Bangladesh, July 28 (BSS) - The High Court today declared illegal the immediate past BNP-led four party alliance government's decision of canceling the status of August 15 as the NationalMourning day.

A two-member bench comprising Justice Mohammad Abdur Rashid and Justice Md Ashfaqul Islam after rule hearing on a writ petition declared the office order of August 3, 2002 illegal andwithout lawful authority.

According to that office order, the government has taken a decision to cancel observance of August 15 as National MourningDay and hoisting of the National flag at half mast.

Earlier, The Awami League government on August 8, 1996 through an office order declared August 15 as the NationalMourning day and also the National holiday.

The then Awami League government took the decision as Bangabandhu Sheikh Mujibur Rahman, founder of Bangladesh, was brutally assassinated along with most of his family members onthis day in 1975 at his Dhanmondi residence.

Advocate Md. Mozammel Haque, a lawyer of the Bangladesh Supreme Court, and two others jointly filed a writ petition before the High Court division on August 6, 2007 challenging the legality of the office order issued on August 3, 2002 cancelingthe previous office order of August 8, 1996.

Counsel for the State, Assistant Attorney General (AAG), Jafar Imam while talking to reporters after pronouncement of the judgement said the High Court in its verdict recognized Bangabandhu Sheikh Mujibur Rahman as the declarer of thecountry's Independence and the Father of the Nation.

Petitioner of the writ Advocate Mozammel Haque expressing his profound satisfaction over the judgement said this verdict would undoubtedly be considered as a milestone in the history ofBangladesh.

Earlier, a Division Bench of the High Court on August 6, 2002 issued a rule asking the government to show cause why theoffice order dated August 3, 2002 should not be declared illegal.
