Extended meeting of judges

Astana, 10 January 2008, (Khabar) - The chairman of the Supreme Court of Kazakhstan Kayrat Mami has conducted an extended meeting with judges where he was presented with the report for 2008. In general, Kayrat Mami was satisfied with the work of the courts but of course there were also some unfavourable comments.
The chief judge believes that the crisis can lead to labour, economic and other disputes. So, law-enforcement agencies and the justice system will affect the realisation of anti-crisis measures defined by the head of state. At the meeting, it was noted that the courts have started to work faster but not necessarily with better quality. For example, simple cases can be full of gross errors. The most common disadvantage in the work is the failure of witnesses to show up which leads to delays in cases.

- The case was very complicated, which is why different delays have taken place.

Kayrat Mami, chairman of the Supreme Court of Kazakhstan:
- So, he shouldn’t take any other cases. And I think he was bribed.

Currently, Almaty city court does not have any outstanding criminal cases, except two that are currently under examination. Also, it was noted that some judges are not able to work under the new conditions. Last year 32 Almaty judges were disciplined, with five of them having been sacked and seven forced into retirement.

Tlektes Barpibayev, chairman of Almaty city court:
- We have created extra groups which are responsible for checking complaints and undertaking certain measures.

As part of the Supreme Court plan for three years, it is planned to create special inter-district courts, which will be responsible for the consideration of the most complicated criminal cases, including cases with the participation of juries. Also, it is planned to instil the principle of uninterrupted trials.

Ulbosyn Suleymenova, judge of RK Supreme Court:
- The consideration of cases is being postponed without reason. Despite the judge keeping a record of the case, real measures on the suppression of procrastination are not being undertaken.

At the meeting, Kayrat Mami noted that the approval of arrests by the court provides a high level of protection for human rights and freedoms.
