All Afghans Have Equal Rights Constitutionally

Kabul (BNA) Exactly thirteen years passed since the reification of the constitution as the mother law. But in this period the assessments took place on knowhow of implementation of this national deed through different sources specially those who have undertaken law enforcement duty, witness that the provision of the constitution is socio, political, economic activities, have not been exercise as it was expected and lack of observance of constitution has caused violation of citizens rights. Often the law provisions have been violated by senior government authorities, irresponsible armed groups, ANP etc who are actual guardians of law and there are many violations, which stemmed from political attitudes, pressures, use of arms and military power particularly through irresponsible armed groups. The officials of national’s legal authority, courts and ATO who were involved in these crimes, have been exonerated due to political pressures and recommendation of authorities concerned and criminals were exonerated. Such issues can be found in the criminal cases of corruption, land occupation. It should be said that a number of criminals including, drug traffickers and corrupt elements who are identified based on evident, have not been punished and even their embezzlement cases have been ignored. It is impossible that hundreds criminals cases in the last stages of their files, have been exonerated due to unknown reasons while ordinary individuals who lack mediation or money, were sentenced to many year’s jail for even bribery or embezzlement of Afs 500 and spent many years behind the jail bars and spent long times in uncertainty in jail despite of thirteen years after ratification of the constitution. If our people and law enforcement bodies remember that in the taking oath ceremony of NUG establishment, the president promised in his loyalty declaration that he would eliminate corruption immediately and his first step was taken on Kabul Bank scandal which was a practical step. But two years now, the destiny of this case is unknown as several other cases have been affected with same destiny. Today it is a common proverb among law enforcement authorities that address people that if you have money or power, don’t care about law but if you lack both, you will be called as lawbreaker and criminal and have to spend many years in jail behind bars. Today ordinary people witness that law is broken or violated by lawmakers or law enforcement bodies because ordinary people actually don’t dare to break or violate law. It should not be forgotten that honesty in duties based on Islamic Shariah is an effective solution in implementation and observance of constitution and other laws. If reforms are started from higher authorities, no doubt all people would observe law. Awareness of laws provisions is the basic condition of its implementation.
