KPU DISCUSSES SUPREME COURT DECISION
Jakarta, Aug 1 (ANTARA) - The General Elections Commission (KPU) held a plenary session here Saturday to discuss among other things about the follow up of Supreme Court (MA) decision that annulled several articles of the KPU's regulation no.15/2009.
"We will hear the legal affairs analysis conducted by the (KPU)'s legal affairs bureau. We have received inputs and responses from the people, which we will study," the KPU's staff member, Endang Sulastri said before opening of the meeting.
The MA in a recent ruling annulled Article 22, section C and Article 23, Sub-articles 1 and 3 of KPU Regulation 15/2009 regarding the method to distribute second-phase legislative seats.
Due to the decision, a number of political parties would get fewer seats in the parliament.
Regarding the KPU's measure over the MA's decision, the KPU should consider the installation schedule of the provincial and district/town legislative assembly members which among others will take place on early August 2009, she said.
"This is one of the matters that will be discussed, which have to do with the legal position and the legal argument," she cited, adding that her side also analyze all of inputs and facts received which will then be followed by the decision to be taken.
On March 16, 2009, MA through its decision no.58/P.PTS/VII/13 and the KPU P/HUM/TH.2009 ordered the KPU to cancel and revoke Article 38 paragraph 2 letter b and article 37 letter b KPU Regulation no. 15/2009. Both articles are set on the seat member of the provincial Legislative second stage.
Then, on May 14, MA through through its decision no. 59/P.PTS/VII/15 P/HUM/TH.2009
ordered the KPU to cancel and revoke Article 22 letter c, and article 23 paragraph letter 1 and 3 fo the KPU's rule 15/2009.
In addition, MA also ordered the KPU to revise the KPU' decision No 259/Kpts/KPU/2009 about the determination of political party gain in the parliamentary seats.
Then, on June 2, MA issued a decision number 60/P.PTS/VII/16 P/HUM/TH.2009 that ordered the KPU to revoke the order and cancel the article 45 letter b and section 46 paragraph 2 letter b of the same regulations.
Finally, on June 10, MA ordered KPU to cancel and revoke Article 25 and improve the article 25 of the KPU regulation no 15/2009. ***
