NSW MPs reject motion to sack magistrate

SYDNEY (AAP) - Oct 13 - NSW upper house MPs have voted against sacking a Sydney magistrate suffering from bipolar disorder.
The Legislative Council rejected a motion to remove Magistrate Brian Vincent Maloney by a vote of 15 to 22 on Thursday.
MPs were given a conscience vote on the issue, which relates to four complaints against Mr Maloney between 2002 to 2010.
The Judicial Commission had called for Mr Maloney's removal, saying that while his inappropriate behaviour had been caused by bipolar 2 disorder, and he had since been treated, he remained "incapacitated" for the job.
One complaint related to an instance when he asked a pregnant psychiatric registrar to stand up and "show us that you're pregnant".
Another related to a screen saver of a naked woman, which he showed to female colleagues at a 2002 legal seminar.
Mr Maloney is the second magistrate this year to have their fate considered by the upper house.
In June Magistrate Jennifer Betts, who was suffering depression at the time of her offences, was also spared being removed from the bench.
