KPU, HOME MINISTER DISCUSS AMENDMENTS TO ELECTION LAW

Jakarta, Dec 31 (ANTARA) - Members of the General Election Commission (KPU) and Home Minister Mardiyanto have started to discuss the substance of a government regulation in lieu of law (Perppu) to amend the General Election Law.

KPU Chairman Abdul Hafiz Azshary said here on Wednesday the substance to be corrected by the Perppu had among other things to do with the marking of ballots, the auditing of campaign funds and arrangement of legislative candidates on the basis of the number of votes they had won.

"The materials forwarded first pertained to the ticking of ballots. The president is of the opinion that double marks are legitimate in order to minimize the number of invalidates ballots," he said after attending a meeting with Constitutional Court judges and KPU members.

Hafiz said Law No 10/2008 on legislative elections had underscored one mark in the columm of party names or that of legislative member or columm on the number order of legislative members.

If there were two marks by giving one in the colum of party names with the columm on the names of legislative members or number order of legislative members, a legal umbrella was needed as the existing law only allowed one mark.

In the meantime, other materials forwarded for Perppu are about audits of campaign funds. Law No 20/2008 emphasized the need for an audit report on campaign funds used by participants of general elections at central, provincial and district/mayoral levels.
"Cost spent on auditing till all levels is also big, reaching Rp1 trillion. This is certainly burdensome," he said.

Other materials needed to be arranged in Perppu are about confirmation of legislatives nominees of the House of Representatives and Provincial Legislative Assembly on the basis of majority votes.

Even the Constitutional Court's Chairman, Mahfud MD, said the decision of the Constitutional Court on announcement of legislator elect on the basis of majority vote tally, Fafiz saw that it was much better if this point was arranged in Perppu.

"If the Perppu on this is available, it will support the work of KPU eventhough there has been a guaranty from the Constitutional Court," he said adding such requirements specified in the law are difficult to meet.

Therefore, KPU requested for a concession which will be arranged in Perppu.
