GOVT WELCOMES MK'S RULING BARRING INDEPENDENT PRESIDENTIAL CANDIDATES

Jakarta, Feb 17 (ANTARA) - The government has welcomed the Constitutional Court's decision to turn down the request of a few citizens to review the law stipulating that only political parties can nominate persons for the presidency and vice presidency.

Law and Human Rights Minister Andi Mattalatta said here Tuesday, the MK ruling was in line with Law Number 42 of 2008. "That is the spirit of our law (Law Number 42/2008). Our system of government is indeed presidential but a lot of presidential authority requires parliamentary support," he said.

The MK had rejected the judicial review request submitted by Fadjroel Rahman, Mariana and Bod Ferdian.

With the NK's decision, the chance for independent or non-party candidates to contest the next presidential election had completely vanished.

Andi said the 1945 Constitution indeed required candidates from political parties.

When asked about the 20 percent vote requirement for a party to be able to nominate a presidential candidate the minister admitted that it was not regulated by the 1945 Constitution but the constitution allowed a law to regulate it.

He further said that the 1945 Constitution also required not an individual but a collective nomination through a political party. "Indeed the minimum votes for candidacy is 20 percent but it is not impossible that the requirement will change in the future," he said.

He said what was needed was a strong government, supported by the parliament.***
