Varun withdraws bail plea, has no protection against arrest

New Delhi, Mar 27 (PTI) BJP leader Varun Gandhi, who is
facing a criminal case for his alleged anti-Muslim speeches,
Friday withdrew his bail plea from the Delhi High Court which
had earlier provided him interim protection from arrest by the
Uttar Pradesh Police.

With 29-year-old Gandhi withdrawing the bail plea, the
restrain order passed by the High Court against his arrest
stands vacated.

The counsel for the BJP candidate for Pilibhit said since
the Allahabad High Court has refused to quash the FIR
registered against him for election speech, he was withdrawing
the petition on which he was granted anticipatory bail.

"Keeping in view of Allahabad High Court order, we seek
to withdraw the petition," senior advocate Siddharth Luthra,
appearing for, Gandhi said told the court.

As Gandhi's plea was not objected by the Delhi
Government, Justice Reva Khetrapal allowed him to withdraw the
petition.

At the outset, the counsel, appearing for the grandson
of former Prime Minister Indira Gandhi, brought to the notice
of the court the Allahabad High Court order which had refused
to quash the FIR filed against Varun and pleaded that he
should be allowed to withdraw the petition.

"Without going into the issue of maintainability and into
the merits of the case, the petition is dismissed as
withdrawn," Justice Khetrapal said.

Varun, who faces maximum punishment of three years of
jail term, was booked on March 17 under Sections 153A
(promoting enmity between different groups on ground of
religion) and 188 (disobedience to order duly promulgated by a
public servant) of the Indian Penal Code and Section 125 of
the Representation of the People Act.

The Court, earlier on March 30, had restrained the
police from taking any coercive action against him for the
alleged inflammatory communal speech till Allahabad High Court
decided his plea on quashing of FIR against him.

But the Allahabad High Court had on March 25 rejected
his plea for quashing of an FIR filed against him. PTI AAC KRH
