Kashmir's liberation included in 26/11 charges: Judge
Mumbai, May 25 (PTI) A special court, hearing the Mumbai
terror attacks case, Monday said the alleged objective of the
conspiracy hatched by Lashkar-e-Toiba to liberate northernmost
state Jammu and Kashmir from India is included in the charges
framed by it and there is no need to specify this separately.
Judge M L Tahaliyani said this aspect of LeT's plan to
liberate Kashmir is included in the charges relating to
"Waging war against the nation" and "conspiracy".
The court therefore felt that it is not necessary to
mention it separately in the charges, as contended by special
public prosecutor Ujjwal Nikam.
Accordingly, the court disposed of an application filed
by Nikam seeking to modify the charges.
Nikam had contended that the objective of capturing
Kashmir should be clearly spelt out in the charges.
The Judge said he had taken into account the confession
made by accused Mohammed Ajmal Amir Kasab who said one of the
objectives of the LeT was to strike terror at many places to
destabilise the nation and also to separate Kashmir from
India.
The court made it clear that it had not rejected or
dropped this aspect of the conspiracy in the charges framed by
it earlier. Hence, there was no need to modify or amend the
charges to include the objective of capturing Kashmir. PTI SVS
