PRESIDENT ASKED TO ISSUE DECREE TO FORM RIGHTS COURT
Jakarta, Oct 7 (ANTARA) - The Institute for Policy Research and Advocacy (Elsam) has asked President Susilo Bambang Yudhoyono to immediately issue a decree on the formation of a human rights ad hoc court to settle missing person cases that happened in 1997-1998.
"The president should immediately issue a presidential decree on the formation of the human rights ad hoc court to investigate and try the perpetrators behind the missing person cases in the 1997-1998 period," Elsam senior program officer Amirudin Harahap said here on Wednesday.
He said the absence of a presidential decree for the formation of a human rights ad hoc court had created uncertainty in the solution of the cases in which a number of human right activists had disappeared without a trace.
According to Harahap, the president's lack of inititive on the matter could have a negative impact on the public's opinion about his commitment to respect for human rights, and on the performance of cabinet members after Yudhoyono is inaugurated as president on October 20, 2009.
He said the recommendation from the House of Representatives (DPR) to the president in relation with the missing person cases was a continuation of the implementation of Law No.26/2000 on the formation of a human rights court.
Point 2 of article 43 of Law No.26/2000 says, "A Human Rights Ad Hoc Court as called for in point 1 can be formed through a presidential decree on the basis of a House of Representatives proposal based on certain events."
Harahap also said the recommendation from the DPR to the president about the missing person cases was the first test for the new government under President Susilo Bambang Yudhoyono and Vice President Boediono in the 2009-2014 period.
Earlier, on September 28, 2009, the DPR of the 2004-2009 period at its plenary session recommended that the government solve a number of missing person cases that happened in the 1997-1998 period.
The DPR recommended that the president immediately form a Human Rights Ad Hoc Court, and try to find the 13 people whom the Human Rights Commission had declared missing.***
