News Focus: GOVT FORMS FACT-FINDING TEAM ON BIBIT-CHANDRA CASE

Jakarta, Nov 2 (ANTARA) - President Susilo Bambang Yudhoyono has decided to set up an independent fact-finding team on the case of Bibit Samad Rianto and Chandra M Hamzah, two deputies of the Corruption Eradication Commission (KPK) being detained by the police over alleged abuse of authority relating to the issuance of a travel ban on businessman Anggoro Widjojo.

Chaired by Adnan Buyung Nasution with Koesparmono Irsan as deputy and Denny Indrayana as secretary, the fact-finding team has five other members, namely Anies Baswedan, Tudong Mulya Lubis, Amir Syamsudin, Hikmahanto Juwana and Komaruddin Hidayat, Political, Legal and Security Affairs Coordinating Minister Djoko Suyanto said here on Monday.
The team will provide the president with reports in the next weeks on facts they have to verify following the controversial detention of the two KPK deputies which in the few days had triggered much criticism in the public.

"We are only given two weeks and after that the result of our recommendation should then be reported directly to the president," Adnan Buyung said in a press conference at the state palace.

"Event we have just been formed just within a few hours, the team will be trying hard to be open to the community. We also want to communicate with the journalists transparently with one condition that the results should be firstly reported to the president," he said.

Named as fact clarification and legal process team, the team will have to verify the facts which have dragged Bibit and Chandra to detention cells as suspect over the abuse of authority.

Before the establishment of this team, the Democratic Party had earlier urged President Susilo Bambang Yudhoyono to maintain the credibility of Corruption Eradication Commission (KPK).

"The president has a tendency to maintain the credibility of KPK and therefore we urge him to do so," Democratic Party chairman Hadi Utomo said here on Sunday.

Asked to comment on the conflict between the KPK and the National Police (Polri), Hadi Utomo said he shared
President Yudhoyono's opinion.

"President Yudhoyono never interferes with things related with legal case," Hadi Utomo said after opening Democratic Party's regional conference in Surabaya on Sunday.

He added that the president would only help solve things related to inter-state institutional problem.

"But if they relate to legal substance, the president will never interfere, and it could be seen in his leadership during the past five year," the president's brother-in-law said.

Hadi Utomo, on the occasion, said the detention of suspended KPK leaders Bibit Samat Riyanto and Chandra M Hamzah by the police on Thursday did not influence the KPK performance.

In the meantime, Nahdlatul Ulama Muslim Organization (NU) chairman Hasyim Muzadi earlier said President Susilo Bambang Yudhoyono should intervene in the case between the police and the Corruption Eradication Commission (KPK).

"The head of state should lend a hand," he said.

Muzadi was of the opinion that the case of suspended KPK deputy chairmen Bibit Samad Riyanto and Chandra M Hamzah who were detained by the police last Thursday could not be considered an individual case.

"Chandra and Bibit are individuals and it is true, but there is a disbelieve between each institution," Muzadi said.

Therefore he added that the detention of Chandra and Bibit should be a starting point to put KPK and the police to the appropriate proportion.

"The key to solve the problem is in the hands of the president," Muzadi said, adding that he disagreed with President Yudhoyono's statement not to intervene in the case.

The NU chairman also asked the Police to immediately explain to the public about the accusation against Bibit and Chandra which sparked reactions.

The State Enterprises (BUMN) Watch on Sunday also suggested that President Susilo Bambang Yudhoyono (SBY) seek clarification from the Corruption Eradication Commission (KPK) on the recent detention by police of its two suspended commissioners.

President Yudhoyono should ask clarification not only from the national police chief and the attorney general but also from the anti-graft body, BUMN Watch chief Naldy Nazar Haroen said.

Yudhoyono needed to ask KPK about various issues such as the circulation of a transcript of a tapped phone conversation containing engineered materials aimed at criminalizing the KPK commissioners, Naldy said.

In addition, the president also needed to ask the KPK why several interim KPK leaders had threatened to resign following the detention of the two suspended KPK leaders, he said.

"The active KPK leaders should give a press conference like what the national police chief has done so that the public will not get confused and consequently, come to wrong decision," he said.

The presence and credibility of KPK should be maintained because it is the only agency expected to combat corruption in the country, he said.

"If all interim KPK leaders are to resign, the KPK's image will increasingly be tarnished," he said.
On Oct 29, police detained Bibit Samad Rianto and Chandra Hamzah who had previously been named suspects for alleged abuse of authority over the issuance of a travel ban on businessman Anggoro Widjojo and also the issuance of a travel ban and later its revocation for businessman Djoko Tjandra.

The arrest has drawn mixed reactions. Many saw the case as the result of a rivalry between the KPK and Police. Earlier, over the investigation of its deputies, the KPK accused the National Police`s chief detective, Commissioner General Susno Duaji, of carrying out nonprocedural examinations, and the police had thus acted against the two KPK vice chairmen on trumped-up charges. ***3***
