Sitting of Constitutional Council

Constitutional Council has discussed address of Prime Minister about official interpretation of norms of article 4 of the Constitution. The matter concerns the mechanism of realization of decisions adopted by the commission of Customs Union and procedures that will be carried out by state structures of Kazakhstan, Russia and Belarus. The commission was founded on October 6, 2007. The lawyers try to check up if decisions of commissions are coordinated with national legislation and if they are of advisory or obligatory character. The Constitutional Council will issue the decree on this issue in time settled by the law.

Marat Sarsembayev, expert, doctor of law:
- This is all new for us because we didn’t sign this kind of contracts until now. Exactness or incorrectness will be known when a problem arises before man and before the legal entity or the state.

Natalya Slyusar, director of the Legal Department of the Eurasian Economic Community:
- The solutions of commission of the Customs Union don’t require any further ratification and they are not an international treaty. The whole practice of international organizations said that bodies accept the political obligations. They are political obligations arising from the contractual statutes of international organizations, bound by the decision makers. But these solutions will not exceed the authority given by the states.
