TEAM OF EIGHT NOT TO DICTATE PRESIDENT

Jakarta, Nov 16 (ANTARA) - Adnan Buyung Nasution said the Team of Eight did not wish to dictate President Susilo Bambang Yudhoyono with the recommendations it would submit on Tuesday.

At a press conference here on Monday, Nasution, the chairman of the team, said the recommendations in a softer language were suggestions for considerations though in stronger words they meant proposals that the President had to implement.

"Of course, as they are recommendations, they are not compelling nor dictating the President. I think this has to be made clear because differences in perception may often have a negative impact. In the Indonesian language, they probably mean proposals for consideration but in strong words, they mean implementation," he said.

The Team of Eight set up by the President to verify the legal facts and processes behind the controversial case of bribery or extortion and power abuse involving antigraft commissioners Bibit Samad Rianto and Chandra M Hamzah on Monday finished making its final report for submission to President Yudhoyono on Tuesday.

The report, consisting of 26 pages, according to Nasution, was quite comprehensive because it tells about all activities done the by team so far including facts they could find and contained conclusions and recommendations.

In view of ethical principles the team would not as yet wish to make the recommendations known to the public before they were received by the President as the one who gave them the mandate for it.

"We are certainly anxious to wait for the result of our work like other people. We certainly hope our work will clarify the problem, put it in right proportions and if mistakes are made they can be corrected immediately," he said.

In its initial conclusion made known last week the team said that the police did not have enough evidence to pursue their bribery or extortion charges against the two anti-graft commissioners.

Regarding the case of power abuse, the team said it was weak because the articles used by the police were "rubber" articles.

Nasution said the team at least had three options to be put into its recommendations.

He said if the case was still in the police's hands, the team would recommend stopping the investigation but if it was already in the hands of the prosecutor's office, it would recommend issuance of an order to stop the investigation in the public interest.

The team in its recommendations to be submitted to the President also called for a reform of the police force and the attorney general 's office, the antigraft body KPK and also the Victims and Witnesses Protection Agency.

It also calls for the cleaning of the law enforcement agencies of case brokering and mafia-like practices, Nasution said.

He said those responsible with regard to polemic on the case also had to be given a sanction to satisfy the public's sense of justice.***
