INDONESIAN LABOURER TO HANG FOR DRUG TRAFFICKING
Shah Alam (Malaysia), Dec 4 (ANTARA/Bernama) - A labourer from Indonesia was sentenced to death by the High Court here Friday for trafficking in 1.7kg of ganja last year.
Alan Setiawan, 39, was found guilty of trafficking in the drug ata
fertiliser godown in Port Klang at 8.30pm on April 25 last year.
The offence under section 39B (2) of the Dangerous Drugs Act 1952 carries the mandatory death sentence on conviction.
Judicial Commissioner Mohd Yazid Mustafa held that the prosecution had proven beyond reasonable doubt that Alan was carrying the drug when he was arrested.
He said Alan had claimed in his defence that the plastic bag containing the drug was carried by his friend, Udin, who threw it to the floor and fled when police raided the place, leaving him to face the music.
However, he said, a witness had testified that there was no Udin and he clearly saw Alan carrying the bag and throwing it when police raided the place.
He also found Alan's defence that he had gone to the place with Udin to look for a job and had been offered one before he was caught unreasonable as there was no one around.
Alan was represented by K.A.Ramu while deputy public prosecutor Mohd Nordin Ismail appeared for the prosecution.
